Terms of Service

These terms apply when your academy uses Bilza by Wittier. By creating an account you agree to them on behalf of your academy.

Who you are contracting with

Bilza is provided by Wittier, No. 2, 3rd Cross, 5th Block, Nandini Layout, Bangalore - 560096, India. In these terms “we” and “us” mean Wittier; “you” means the academy that holds the account.

Your account

  • You must give accurate details when you sign up, and keep them up to date.
  • You are responsible for what happens under your account, including what the staff you invite do with it.
  • Keep sign-in details private. Tell us promptly at contact@wittier.in if you think someone has gained access to your account.
  • The person who creates the account confirms they are authorised to accept these terms for the academy.

Your data stays yours

Everything you put into Bilza — your students, classes, fees, staff and messages — remains yours. We do not claim ownership of it and we do not sell it. We hold it to provide the service to you, as described in our Privacy Policy. You can export your records from within the application, and you can ask us for a copy at any time.

What you are responsible for

You decide what you record about your students and their families. That makes you the Data Fiduciary for those records under the DPDP Act. In particular:

  • You must have the consent you need before entering someone’s details — including the verifiable consent of a parent or guardian for any student under 18.
  • You must only send messages to people who have agreed to receive them, and you must honour a request to stop. Messaging providers such as WhatsApp have their own rules, and those apply to what you send.
  • The fees, invoices and receipts you issue through Bilza are yours. You are responsible for their accuracy and for any tax due on them.
  • You must not use Bilza to break the law, to send unsolicited bulk messages, or to store data you have no right to hold.

What we are responsible for

We will provide the service with reasonable care and skill, keep it reasonably available, and tell you in advance about planned maintenance that will interrupt it. We will handle your data as set out in our Privacy Policy, and only on your instructions where we act as your processor.

We do not promise that the service will never be unavailable or error-free. Where we get something wrong, tell us and we will put it right.

Fees and payment

Charges for Bilza, where they apply to your plan, are payable in advance for each billing period. Prices shown on our website are indicative while we finalise our plans; the prices that apply to you are the ones we agree with you in writing. We will give you notice before any price change takes effect, and you may cancel rather than accept it.

Fees your academy collects from parents are between you and them. We are not a party to that transaction, and money collected through a payment gateway is settled to your account by the gateway under its own terms.

Third-party services

Bilza connects to services we do not control — payment gateways, WhatsApp, SMS and email providers. Their availability and their rules are theirs, not ours. If one of them fails or changes its terms, we will do what we reasonably can, but we are not liable for their acts or omissions.

Suspension

We may suspend an account that is being used unlawfully, that is harming the service or other customers, or that has unpaid charges we have asked about and not received. Except where the law or an immediate risk requires otherwise, we will tell you first and give you a chance to put it right.

Ending the agreement

You may close your account at any time. We may end the agreement by giving you 30 days’ notice. When an account closes you can export your data; after a reasonable period we delete or anonymise it as described in the Privacy Policy, keeping only what the law requires us to keep.

Liability

Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

Otherwise, neither of us is liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or anticipated savings. Our total liability to you in any twelve month period is limited to the amount you paid us for the service in that period.

You remain responsible for keeping your own records as your law requires. Do not rely on Bilza as your only copy of something you are legally obliged to retain.

Changes to these terms

We may update these terms. If a change materially affects you we will give you reasonable notice before it takes effect, and you may close your account if you do not accept it. The date at the top of this page tells you which version is current.

Governing law

These terms are governed by the laws of India, and the courts at Bangalore, Karnataka have jurisdiction over any dispute. Before going to court, please contact us — most problems are quicker to fix directly.
